The Fifth Circuit Court of Appeals recently affirmed a $730,000 verdict in favor of Richard Craven who injured his knee when he fell through a hole on the deck of a barge.  The defendant failed to warn about or cover the hole, even though they knew that deckhands routinely walked across the barge in unlit conditions at night.  An additional confidential settlement was reached with another defendant just before trial.

The award will help to pay for the deckhand’s medical expenses and his lost wages.  Mark Lumpkin and Jim Reeves tried this case and successfully defended the appeal.
